The Federal High Court in Abuja, Justice Joyce Abdulmalik has struck out the case filed by the Independent Corrupt Practices Commission (ICPC) against some senior officials of the Kano State Independent Electoral Commission (KANSIEC)

The officials involved include the Chairman of KANSIEC, Professor Sani Lawal Malumfashi; the Secretary of the Commission, Anas Muhammed Mustapha; and the Commission's Director of Finance, Ado Garba.

The case, with number FHC/ABJ/210/2025, was scheduled for their arraignment on Monday, but the proceedings could not continue because the defendants did not appear in court.

They are accused of 10 counts of allegedly diverting 1.02 billion Naira during the 2024 local government elections.

At the previous hearing, the ICPC's lawyer, Enosa Omoghibo, a Deputy Director in the Commission's Legal Department, informed the court that, "Today was scheduled for their arraignment, but the defendants have not come to court."

However, the Defense Counsel, M.A. Magaji, SAN, stated that the defendants had not been served with the charge sheet and other court documents. He emphasized that proper service of processes is fundamental to establishing the court's jurisdiction.

Justice Abdulmalik had then adjourned the case to Monday, November 24th, to allow for the proper service of the documents and to ensure the appearance of all parties involved.

On the Monday the case was rescheduled for their arraignment, the defendants again failed to appear, which led the judge to strike out the case.
